HOLIDAYS. HOLIDAYS.
Section 1. All employees shall receive holiday pay for the following holidays: January 1st Labor Day ▇▇▇▇▇▇ ▇▇▇▇▇▇ ▇▇▇▇ Day Thanksgiving Day Presidents Day December 24th Memorial Day December 25th Juneteenth (June 19th) Employee's birthday July 4th All employees who have completed their probationary period shall receive holiday pay for two (2) personal holidays each year. The observance of Presidents Day shall be on the third (3rd) Monday of February, the observance of Memorial Day shall be on the last Monday in May, and the observance of Labor Day shall be on the (1st) Monday following the first Sunday in September. The observance of the employee's two (2) personal holidays shall be mutually agreed to by the employee and his/her supervisor five (5) days in advance and scheduled so as not to interfere with the normal operations of the Authority. The Authority shall be required, however, to allow no less than three (3) employees at each district the same day off if requested. Such personal holidays shall not be observed on the same day as any of the aforementioned holidays. Such holiday pay shall be eight (8) hours at the employee's respective straight time rate. Personal holidays must be used within the year granted or they shall be lost.
Section 2. If any employee is required to work on any of these six (6) legal holidays: January 1st, Memorial Day, July 4th, Labor Day, Thanksgiving Day, Christmas Day, or on the employee's birthday, the employee shall be paid time and one-half for such work without prejudice to the right to receive his/her holiday pay in full.
Section 3. If a holiday falls on Sunday, it shall be observed on the following Monday. However, those employees that work on Sunday, for the six legal holidays identified in Section 2, will be paid time and a half for the hours worked. All eligible employees will receive the eight (8) hours of holiday pay on the Monday and any worked hours would be paid at straight time, unless otherwise provided herein. If a holiday falls on Saturday, it shall be observed on Friday. However, those employees that work on Saturday, for the six legal holidays identified in Section 2, will be paid time and a half for the hours worked. Section 10.2 All holidays shall be observed on the Commonwealth's legal holiday unless an alternative day is designated by the Employer.
Section 10.3 When a holiday occurs on the regular scheduled workday of a full-time employee, he/she, if not required to work that day, shall be entitled to receive his/her regular day's pay for such holiday. An employee required to work on a holiday shall receive compensatory day off with pay within sixty (60) days following the holiday to be taken at a time approved by the agency head or if a compensatory day cannot be granted by the Agency/Department because of a shortage of personnel or other reason, then he/she shall be entitled to pay for one day at his/her regular rate of pay in addition to pay for the holiday worked.
Section 10.4 When a holiday occurs on a day that is not an employee's regular workday, he/she, at the option of the Employer shall receive pay for one day at his/her regular rate or one compensatory day off with pay within sixty (60) days following the holiday to be taken at a time approved by the agency head.
Section 10.5 Effective January 1, 2008, notwithstanding any other contract provisions, an employee who is required to work his/her regular shift on a holiday (and the employee was otherwise not scheduled to work said holiday), shall be entitled to elect, for the first five times per calendar year that such occurs, to receive either: (a) one day’s pay in addition to regular pay for compensation for working on the holiday; or (b) a compensatory day off with pay within sixty days following the holiday to be taken at a time requested by the employee and approved by the agency head or if a compensatory day cannot be granted by the agency/department because of a shortage of personnel or other reasons then he/she shall be entitled to pay for one day at his/her regular rate of pay in addition to pay for the holiday worked. HOLIDAYS. 26.01 Full-time employees shall be entitled to the following holidays with pay: New Year's Day Family Day Good Friday Victoria Day Canada Day Civic Holiday Labour Day Thanksgiving Day Christmas Day Boxing Day A Floating Holiday If the federal or provincial Government declares another statutory holiday, it shall replace the Floating Holiday mentioned above.
26.02 Holiday pay shall be computed on the basis of the number of hours the employee would otherwise have worked had there been no holiday, at the employee's regular straight time hourly rate of pay.
26.03 In order to qualify for holiday pay, the employee must work his/her full scheduled hours of work on his/her work day immediately preceding and immediately following the holiday unless excused by the Company or the employee was absent due to:
(a) regularly scheduled vacation;
(b) an employee's regularly scheduled day off;
(c) absence due to sickness or accident supported by a doctor's note or a leave of absence.
26.04 In the event that any of the above holidays fall on a Sunday, the Company agrees to schedule another day off, with pay, in lieu of the holidays set out above.
26.05 Where an employee is required to perform work on one of the above-mentioned holidays, he/she shall be paid time and one- half (1½) his/her regular straight time hourly rate for all hours worked in addition to another day off with pay in lieu of the holiday as set out above.
(a) Where a holiday falls during an employee's scheduled vacation period his/her vacation shall be extended by one day or a day may be taken at a later date by mutual agreement between the employee and the employer within two (2) weeks.
(b) Where a holiday falls during an absence unpaid by the Company, including lay-off, the employee will not receive holiday pay.
(c) Where a holiday falls while an employee is on sick leave, he/she shall not receive holiday pay but will continue to receive sick pay to which he/she is entitled.
(d) If a statutory Holiday falls on an employee's day off, they should be allowed a day by mutual agreement at a later date within the same monthly accounting period.
HOLIDAYS. Whenever payment of a Loan to be made or taken hereunder shall be due on a day which is not a Business Day such payment shall be due on the next Business Day (except as provided in Section 4.2 [Interest Periods]) and such extension of time shall be included in computing interest and fees, except that the Loans shall be due on the Business Day preceding the Expiration Date if the Expiration Date is not a Business Day. Whenever any payment or action to be made or taken hereunder (other than payment of the Loans) shall be stated to be due on a day which is not a Business Day, such payment or action shall be made or taken on the next following Business Day, and such extension of time shall not be included in computing interest or fees, if any, in connection with such payment or action.

HOLIDAYS.
SECTION 1. OBSERVED HOLIDAYS Employees (including those on temporary appointments) who are appointed at a designated percentage time shall be entitled to a total of eleven (11) paid holidays each fiscal year. The holidays shall be seven (7) "observed" and four (4) "floating/personal."
A. On the Twin Cities campus, three (3) of these holidays shall be scheduled by the University. One (1) will be designated as a personal holiday to be taken at the employee's discretion, with the supervisor's approval, in accordance with the University's guidelines on the use of personal holidays.
B. Coordinate campuses, Minnesota Extension, and CUHCC shall establish their own policies for these days. Observed holidays that fall on Saturday shall be observed on the preceding Friday. Observed holidays that fall on Sunday shall be observed on the following Monday. For employees whose schedules include Saturdays and/or Sundays, the observed holiday shall be on its actual day of occurrence instead of on the preceding Friday or following Monday.
SECTION 2. HOLIDAY WORK An employee entitled to a paid holiday leave who is required to work on a holiday shall receive regular pay for the day plus additional pay or time off at the rate of time and one-half (1.5) the employee's regular rate of pay for the hours worked. Employees may choose between time off or pay for these hours unless payment in cash is prohibited by funding source or availability of funds as determined by the Department.
SECTION 3. HOLIDAY TIME OFF When a holiday falls on an employee's day off, the employee shall receive an additional day off, or proportionate time off (based on the percentage time of appointment) as agreed upon between the employee and the supervisor. If the employee and the supervisor cannot agree on the day to be taken within the pay period, the time shall be converted to compensatory time or paid in cash at the discretion of the Employer.
SECTION 4. HOLIDAY PAY ELIGIBILITY To qualify for holiday pay, an employee must either work or be on an approved paid leave (such as vacation) on the employee's regularly scheduled work day before or following the holiday.

A. If classes are in session on Good Friday, the District will grant a different paid day as the calendar allows.
B. Season employment shall not be included in determining employment status for paid holidays.
C. Should a holiday fall on Saturday or Sunday, the Friday before or the Monday after shall be considered as the holiday, whichever is more applicable.
D. To be eligible for holiday pay an employee must work his/her regular scheduled work day before and his/her regular scheduled work day after the holiday, except if the employee is on vacation, sick leave, or an approved day off.
E. The floating holiday may be used at any time during the school year with the prior approval of the employee's immediate supervisor. Any unused floating paid holiday shall accumulate as additional floating paid holiday time in the following year. There shall be only one (1) accumulated floating holiday at any current time.
